MarkaziAnjumanMatamiGurohaan” Hyderabad, Telangana State, registered vide No. 2529 of 1996 is a religious Society formed with the objectives of promoting co-existence, continuance of Matam, preaching the ideals of Hazrath Imam Hussaina.s, arranging and organizing mourning meetings and processions and to chalk-out the programmes, fixing timings of two processions one MarkaziJuloos-e-Arbayeen and Chup Tazia (Silent Procession) and to attend administrative matters.Ever since the date of registration, elections are being conducted from time to time and presently Mr. Syed Najaf Ali Shoukatis rendering the services as president of the society.
In the year 2020-2021, Mr. Syed Haqayaq Ali Khan and others with ulterior motives conspired together claiming to be self-styled office bearers of Markaz(MAMG)got filed a Suit in O. OP. No 10 of 2021 and also filed IA No 158 of 2021on the File of IIIrdAddl Chief Judge City Civil Court Hyderabad through self –Styled, self-proclaimed vice President by name Sri Mushtaq Hussain @ Chotu “seeking grant of ad-interim order/ temporary injection restraining the Syed Najaf Ali Shoukat President MarkaziAnjumanMatamiGurohaan (MAMG) Hyderabad T.S., Registered No 2529 of 1996, General Secretary Syed Ali Raza Abidi and Askari Hussain Treasurer, their men and agents etc, from interfering in the administration of their Society and making any publication or communication in any form or manner displaying and proclaiming themselves to be Office bearers of the Petitioner Society till disposal of main Case O. OP. No 10 of 2021.Afterdue contest the I.A. No. 158 of 2021 on 29-11-2021 was dismissed holding that: “as Just because of the letter heads filed by the Petitioner and letter heads of the different Anjuman, it cannot be readily accepted that Syed Haqayaq Ali Khan Abidi elected as President and earlier body was dissolved”.Further, the Hon’ble court also observed that:“just because nominated their members for the procession and addressed letter Syed Haqayaq Ali Khan Abidi, it does not mean that election is valid. Whatever may be allegations against the first Respondent regarding his behavior in the time of 10th Muharramprocession, first of all the petitioner must show that the earlier body was dissolved and a new body had elected. The Hon’ble Court further observed that when the Respondents specifically opposing such election, basing on such letter heads and election proceedings “the Petitioner cannot seek that the Respondents are no more as office bearers”. Finally held that “In these circumstances, till the main Case dispute is resolved it is not proper to grant any injunction in favor of the Petitioner”.
The self-styled office bearers of the MarkaziAnjumanMataamiGurohaan(MAMG) preferred Revision before the Hon’ble High Court, but failed to obtain any orders and as the things stood thus, in OP No. 10 of 2021, the court observing that the Petitioners are not turning up in spite of several chances, dismissed the OP in default, vide orders dated 18-12-2024.
