Hyderabad, Sept 15(PMI) Senior Congress leader and Mirza Asker Ali Baig has welcomed the Supreme Court’s interim stay on two controversial provisions of the Waqf (Amendment) Act 2025, calling it a significant relief for minority rights.
The Supreme Court stayed:
- The clause requires a person to be a practising Muslim for five years to create a waqf.
- The clause allows government officials to adjudicate waqf encroachment disputes.
Asker Ali Baig, a petitioner in the case, said these provisions were discriminatory, unconstitutional, and harmful to the autonomy of waqf institutions. He argued they violated Articles 14, 21, and 25 of the Constitution and deviated from Islamic traditions.
He emphasized that this was not a symbolic move, but a substantive judicial intervention acknowledging potential flaws and “unconstitutional intent” in the law. While not the final verdict, he called it a step forward in protecting minority rights and legal due process (pressmediaofindia.com)
