Disagreement in ‘Supreme’ on termination of 26 weeks pregnancy..!

 The Supreme Court gave a different verdict on a petition filed by the Central government seeking to recall the permission given to a woman to terminate her 26-week pregnancy. While one of the judges in the bicameral bench of the Supreme Court expressed his reluctance to allow abortion, another judge expressed his opinion that the woman’s decision should be respected.

New Delhi’Oct 11″23(PMI)  The Supreme Court gave a different verdict on a petition filed by the Central government seeking to recall the permission given to a woman to terminate her 26-week pregnancy. While one of the judges in the bicameral bench of the Supreme Court expressed his reluctance to allow abortion, another judge expressed his opinion that the woman’s decision should be respected. Speaking on behalf of the Centre, Additional Solicitor General Aishwarya Bhati asked that the petition be recommended to the Supreme Court bench headed by Chief Justice Justice DY Chandrachud, who expressed a different opinion in the case of Justice BV Nagaratna and Hima Kohli

However, a woman approached the Supreme Court seeking permission for an abortion as she already had two children and was currently pregnant. She told the court that she is suffering from depression and is not financially and emotionally ready to raise a third child. After considering the arguments of the petition, the Supreme Court allowed the woman to have an abortion on October 9 based on the report of AIIMS doctors. However, when the woman was 25 weeks pregnant, the central government approached the Supreme Court. However, after examining the women, a team of doctors gave a report stating that the chances of survival of the fetus were high.

The central government approached the Supreme Court and ordered the doctors to temporarily postpone the abortion on 10th of this month. Recently, the bench of Justice Hima Kohli and Justice BV Nagaratna recommended the case to the bench of the CJI and conducted a hearing on Wednesday. However, referring to the first report given by the doctors that women do not have any problem with abortion, the court expressed displeasure with the latest report. The Additional Solicitor General bench asked why the chances of survival of the unborn child could not be said with such certainty earlier. Hima Kohli opined that which court would say that the heartbeat of a living fetus should be stopped.. Which court would do that? However, Justice Nagaratna stated that he disagreed with Justice Hima Kohli’s comments. The woman’s decision should be respected.(Press media of india)
