Hyderabad’Oct 10(PMI) Honorable Special Sessions Judge for POCSO Court, HACA Bhavan, Nampally, Hyderabad, Smt. T. Anitha has convicted the A1 Musthala Ravi. Ravi, Aged 34 years, U/sec. Sec.5(m)(n) r/w 6 of POCSO Act to undergo Rigorous Imprisonment for life which shall mean imprisonment for remainder of natural life of A1 and U/s 302 to undergo Rigorous Imprisonment for life and U/s 377 IPC to undergo Rigorous Imprisonment for life and 6 months simple imprisonment U/s 182 IPC with a fine of Rs.15,000/- . All the sentences imposed against A1 shall run concurrently. A2 found not guilty and acquitted.
On 08.07.2022 at 20.00 hours father of the victim complained at Musheerabad PS stating that, he has two sons aged 5 & 3 years. As per the usual practice he drops the children at Anganwadi school in the morning & picks them up. Both A1 & A2 developed physical relation and planned to kill the younger son. On 08.07.2022 also victim’s father and mother (A2) dropped them at Anganwadi school at 10.00a.m & went to work. Around 12 O’clock as per plan A2 asked A1 to pick the children from school. Accordingly A1 brought the children and later asked the elder son to sleep in the hall. He took the younger son on his laps and committed un-natural sex. He lowered his pants as well as the kids pants and penetrated his penis into the kid’s anus and also bit the child in several parts of his body and ejaculated his semen. Due to pain the child screamed. A1 was still un-satisfied so he took a pestle from kitchen and inserted it into the child’s anus and beat him cruelly. As the kid was screaming severely, the elder son saw that his brother was bleeding and howling in pain. A1 shouted at the elder son and sent him back to the hall. Due to fear the elder son stayed back in the hall and heard all the cries and pain of his younger brother. Further, A1 beat the child with his fist several times and threw him to the ground, due to which the kid stopped weeping and became unconscious.
After this incident, A1 called the kid’s father and informed that his younger kid accidentally fell down from the chair and sustained head injury. Immediately kid’s father along with A2 reached home. They took the victim child to Gandhi Hospital. During the treatment the victim child expired.
Upon the receipt of this complaint, Sri. K. Surendhar, Sub – Inspector of Police, P.S Musheerabad, registered FIR in CR.no.303/2022 U/secs. 302,377,182, 120(b) IPC & Sec.5(m)(n) r/w 6 of POCSO Act 2012. After thorough investigation Sri. E.Jahangeer Yadav, Inspector of Police, filed charge sheet accordingly.
The Bharosa Centre has facilitated the victim’s family in Counseling, Medical support documentation, 164 Cr.PC briefing, Legal trial proceedings, apart from home visit by Bharosa staff.
The concerted efforts by the Investigating Officer, Sri. K. Surendhar, Sub – Inspector of Police, P.S Musheerabad, Sri. Pratap Reddy, Public Prosecutor, Smt. Kalpana, Legal Support Officer – Bharosa, Other Bharosa Team and Court Duty Officer by name Sri. Sudershan, HC 9398 of Abids PS, contributed immensely during the course of trial which ended in Conviction, being awarded by Smt. T. Anitha, Honourable Special Sessions Judge for POCSO Court, HACA Bhavan, Nampally, Hyderabad.
