CASE FILED BY MUSHTAQ HUSSAIN (CHOTU) SEEKING INJUCTION AGAINST SYED NAJAF ALI SHOUKAT PRESIDENT MARKAZI ANJUMAN MAMATAMI GUROHAAN HYDERABAD REGD NO 2529 OF1996 DISMISSED.        

Hyderabad Jun 13 (Newslines):  Mushtaq Hussain @ Chotu had filed a Suit O. OP. No 10 of 2021 and sought for injunction by filing I.A.No 158 of 2021 in O. OP. No 10 of 2021 restraining Syed Najaf Ali Shoukat President Markazi Anjuman Matami Gurohaan Hyderabad T. S Registered No 2529 of 1996, Syed Ali Raza Abidi General Secretary and Askari Hussain Treasure their men and agents etc, from interfering in the administration of the Society, making any publication or communication in any form or manner displaying and proclaiming themselves to be  Office bearers of the Petitioner Society till disposal of main Case O. OP No. 10 of 2021 WAS DISMISSED BY HON’BLE THE IIIRD ADDITIONAL CHIEF JUDGE CITY CIVIL COURT HYDERABAD. The main Case O.OP. NO 10 of 2021 reposted on 14th July 2022 for enquiry.

The Hon’ble Judge observed “BASING ON OF THE LETTER HEADS FILED BY THE PETITIONER AND LETTER HEADS OF THE DIFFERENT ANJUMAN, IT CANNOT BE READILY ACCEPTED THAT SYED HAQAYAQ ALI KHAN ABIDI ELECTED AS PRESIDENT AND EARLIER BODY WAS DISSOLVED. Further just because Anjuman nominated their members for the procession and addressed letter Syed Haqayaq Ali Khan Abidi “IT DOES NOT MEAN THAT ELECTION IS VALID”. Whatever may be allegations against the first Respondent regarding his behavior in the time of procession, first of all the petitioner must show that the earlier body was dissolved and a new body had elected. The Hon’ble Court further observed that when the Respondents specifically opposing such election, basing on such letter heads and election proceedings “THE PETITIONER CANNOT SEEK THAT THE RESPONDENTS ARE NO MORE AS OFFICE BEARERS”. Finally held that “IN THESE CIRCUMSTANCES, TILL THE MAIN CASE DISPUTE IS RESOLVED IT IS NOT PROPER TO GRANT ANY INJUNCTION IN FAVOR OF THE PETITIONER, EVEN IF A PRIMA FACIE CASE MADE OUT IN THE MAIN CASE. IN THE RESULT THIS PETITION IS DISMISSED. (Newslines).
