GIST OF THE CASE:
This is a case of Ordinary Theft (Auto Mobile Theft) occurred on 26-11-2022, wherein the accused person A1) Tekumalla Akash @ Sonu committed theft of two wheeler vehicle of the complainant and sold to A2 Mohd. Sohail.
INVESTIGATION & PROSECUTION:
On 26-11-2022 at 2105 hours, the complainant Sri Santosh Kumar S/o Yadagiri, age 25 yrs, Occ: Civil Engineer, R/o Laxmi Nagar, Chatrinaka, Hyderabad, lodged complaint at PS Chatrinaka, regarding theft of his two wheeler vehicle. Soon after receiving the complaint, registered a case in Crime No.402/2022, U/s.379 IPC and investigation was taken up by the then S.I. of PS Chatrinaka Sri M. Mahesh. During the course of investigation, the accused person Tekumalla Akash @ Sonu was arrested on 28-11-2022. In this case (12) witnesses were cited and laid the charge sheet within stipulated time.
Sri D. Durga Prasad, Hon’ble Chief Metropolitan Magistrate, Nampally, Hyderabad, conducted the trial into the matter. During the Trial, the witnesses i.e., (07) members were examined in the Court and all of them has deposed their evidence and answered in cross examination done by defense. Basing on the merits of documentary evidence as well as statements deposed by the witnesses, Sri D. Durga Prasad, Hon’ble Chief Metropolitan Magistrate, Hyderabad, has pronounced the judgment on 11-10-2023, declaring that the accused are found guilty and to undergo 15 months Simple Imprisonment.
