The Patna High Court today rejected two PILs challenging the formation of the new government by Nitish Kumar’s JD(U) along with the BJP. After hearing all parties, a division bench comprising Chief Justice Rajendra Menon and Justice AK Upadhyay dismissed the PILs saying that no intervention of the court is required after the Floor Test in the State Assembly.

One PIL was filed by RJD MLAs Saroj Yadav and Chandan Kumar, while the other was filed by Jitendra Kumar, who holds allegiance to Samajwadi Party. They were against the Governor’s decision not to invite RJD, the single largest party to form the government.

The PILs were filed on Friday after JD(U) Chief Nitish Kumar was sworn-in as the Chief Minister with the support of BJP. Mr Kumar had joined the NDA along with 71 legislators and claimed support of 132 MLAs in the 243-member house. He had also won the Trust vote
